Following a suit filed by Elder Eddy Anyanwu, claimant at the High Court Owerri against the member representing Ideato South State Constituency, Hon Ikechukwu Amuka, and another defendant in suit No, HOW/582/2013 for alleged trespass into the claimant’s property at plot P/3 Parcel B Onitsha Road Youth Centre Owerri. The defendants have been commanded by an Order of the court to enter appearance on the suit as the claimant may proceed if he fails to appear and judgment may be given in their absence.
According to the counsel to the claimant, Barr Mbakwe Obi, he told Trumpeta that his client, Elder Anyanwu ran to the temple of justice, when the court when all his efforts to dissuade the defendants from trespassing into his land proved abortive, as Hon Amuka had boasted that no jupiter can stop him from completing the project by engaging the services of security agencies to guard the workers who work day and on the sight.
It was also gathered that the 15th August order of the court by Justice Goddy Anumudu vacation court judge was because the defendants have been dodging court service all the while, which prompted the court to grant the order for subtitled service and adjourned the main hearing for the 22nd of August.
The claimant in his statement of claim disclosed that he has refused to develop the plot of land because there is a pending suit on the land between him and one Dr Christian Igwe from Ideato North in Suit No. HOW/347/2006 who also trespassed into the plot in 2006.
Elder Eddy Anyanwu also cited some of the documents to be relied upon at the trial to include, Certificate of Occupancy Registered as No. 66/66/152, letter dated 7th August 2013 addressed to the defendants, 1986 payment of annual rent, payment of preparatory fee for certificate of Occupancy, payment of registration fee and payment of stamp duty.
However, appealed to the state governor, Rochas Okorocha to prevail on legislator who represents his local government, Ideato South to leave/release his land for him, and also called on the State Commissioner of Police, Mohammed Katsina to withdraw his men (police) at the said site, as the land is not a public place.
