In a swift U-turn, the Imo State government has withdrawn the case it filed against a Spanish Contractor, Mr Lopez and a Nigerian Emmanuel Ben Emenike at the Federal High Court Owerri for an out of court settlement.
The case which was listed for trial and arraignment respectively yesterday did not generate any heat for both the court and counsel as the petitioner (the govt) declined interest in the matter and asked the court for withdrawal through a filed application by their counsel Barr J Nwadike.
When the defense counsel led by Barr (Pastor) Ogbonna Obiefule did not oppose to the application of withdrawal by the state government the Hon Justice S.M. Shuaibu granted the application and the court struck out the case as the parties agreed to settle out of court.
Speaking to Journalists after the proceedings the lead defense counsel, Barr (Pastor) Obiefule commended the intervention and efforts of Mr Mac Donald Amadi towards the peaceful resolution of the matter. He went further to reveal that both parties also agreed to abide strictly by terms of settlement.
Reacting also, Mr Emenike promised to continue with the project for the interest of the good people of Imo state, Imo. The Spanish contractor who looked sick could not talk to the press as he was taken out of the court premises by the officials of the Nigerian Prison Services and was shielded away from probing journalists and photographers.
