2011 Supplementary Case Supreme Court Decides Today

Today at the nation’s apex court, the Supreme Court sitting in Abuja, will rule on the appeal filed by the present Imo State Governor, Rochas Okorocha and All Progressive Grand Alliance (APGA) against the ruling of an Appeal Court sitting in Owerri which granted the Peoples Democratic Party (PDP) and the past governor of Imo State, Dr Ikedi Ohakim the leave to appeal on the ruling of the Federal High Court Owerri as an interested party.

 

The two appellants who joined the matter in the lower court as an interested party is opposing the ruling through their Counsel, Chief Niyi Akintola (SAN) on the grounds that the PDP and Dr Ohakim had gone to the Supreme Court on the same issue which they lost.

 

However, the counsel to Ohakim led by Chief Wole Olanipekun (SAN) in his argument averred that the apex court should dismiss the appeal for failing to meet up to the mandatory requirement before filing the appeal, holds also that the matter is not a post election matter but a constitutional matter.

 

It will be recalled that the main appellants, Senator Ifeanyi Ararume and the Action Congress of Nigeria (ACN) who are seeking the court to interpret the illegality and constitutionality of the 6th May 2011 Supplementary election in Imo State did not oppose the leave granted Ohakim and his party, as they are interested parties.

 

Meanwhile, a group led by Mr Raphael Omosanye has accused the PDP leadership of plotting to remove Gov Okorocha through the apex court.
