Court Disappoints Agbaso …Says He Was Given Fair Hearing, Denied Jurisdiction

 

 

The hope of the embattled Imo State Deputy Governor, Sir Jude Agbaso to stop his impeachment processes by the Imo State House of Assembly (IMHA) and press for another investigation on the alleged bribery by other government agencies was yesterday shatter when the Hon Justice Florence Duruohaigwe dismissed his suit when she held that the applicant Sir Agbaso’s fundamental right were never violated in any way by the IMHA ad-hoc committee led by Simon Iwunze as he (Agbaso) was given fair hearing and he exhausted it.

 

She also held that the state High Court lack jurisdiction on the case/suit for the listing of 10th respondent, Inspector General of Police who is an agent of the Federal Republic of Nigeria subsequently struck the suit out after a critical consideration of all arguments and the supporting authorities by the applicant and respondent counsel for lack of jurisdiction.

Earlier, in her judgment, the judge said that she could not make an order for the bank statements of account and the MTN call log because she believe that they are irrelevant to the matter.

It will be recalled that Sir Jude Agbaso had gone to court to ask the court to nullify the report of the IMHA. Ad hoc committee alleging infringement/violation of his fundamental right of fair hearing and stop the implementation of the committee’s report and recommendation by any committee or panel.

Sir Agbaso also prayed the court for an order to be investigated by other agencies constituted for financial crimes.

However, the two principle counsel PIN Ikwueto SAN and Niyi Akinlola SAN of the applicant and respondent respectively were conspicuously missing in court during the judgment.
