Court Restores Monarch Okorocha Withdraw Staff of Office

The Traditional Ruler of Lagwa-Okwuato Autonomous Community, Aboh Mbaise Local Government Area HRH Eze Cosmos .E. Onyeneke (Ise of Mbaise) Ekwueme IV of Lagwa has won Governor Rochas Okorocha in an Owerri High Court in a suit he filed against the State Government, Attorney-General of Imo State, the Speaker of, Imo State House of Assembly and Imo State House of Assembly as Defendants/Respondents over the purported withdrawal of Certificate of Recognition and Staff of Office of the Claimant/Applicant, Traditional Ruler of Lagwa Autonomous Community by the State Government (1st Defendant/Respondent).

In the Suit No: HOW/25/2012 which was filed on 25/1/2012, the Plaintiff/Applicant prayed for an order setting aside and or nullifying the purported withdrawal of his certificate of recognition and Staff of Office as the Traditional Ruler of Lagwa Autonomous Community, Aboh Mbaise L.G.A.

In his judgment, the presiding Judge, Hon. Justice T.N Nzeukwu. J. said therefore following and arising therefore, the purported of withdrawal of the Certificate of Recognition and Staff of Office of the Plaintiff during the dependency of the suit as well as the subsisting and valid order of interlocutory injunction of the Honourable Court not to so do made on the 19/6/2012 and accepted by both parties and in particular the 1st and 2nd Defendants/Respondents ably represented in Court that day is a slab on the authority of the Honourable Court and a challenge to the Constitution empowering it to do so.

He made an order setting aside and or nullifying the purported withdrawal of Certificate of Recognition and Staff of Office of Eze Onyeneke as the Traditional Ruler of Lagwa Autonomous Community by the State Government. The Court also restored the status quo ante in the matter as at 19/6/2012 when the court made an order of interlocutory injunction in the Suit.
