Captain Ihenacho May Miss APGA Ticket As Court Fails To Vacate Order Delegates Controversy Mars Assembly Primaries In LGAs

The camp of Captain Emmanuel Ihenacho is said to be in disarray following the inability of a High Court in Imo State to vacate an earlier injunction asking all the parties including his APGA to stay action pending the determination of case instituted by an aggrieved party member.
A concerned APGA stalwart, Kennedy Onyemara had earlier approached an Ihitte Uboma High Court where he asked the court to propel the natural body of APGA not to screen Capt Ihenacho and possibly field him as a candidate since he is not allegedly a party member and entitled not to run for the party’s governorship position come 2015 elections.
Justice E.O. Agada who presided over the matter ordered that the “parties are restrained from doing anything that will destroy or prejudice the subject matter of this suit till the interim injunction application is disposed of” before adjournment till the 25th of November.
When the case came up on 25th November, Ihenachor’s lawyers could not vacate the interim injunction while telling the court that the Emekuku-born shipping mogul did not fault court process by undergoing APGA screening.
However, in the resumed hearing of the matter which came up yesterday, Ihenachor was unable to strike out the injunction and further failed to succeed in providing that the High Court at Ihitte Uboma lacked jurisdiction to hear the matter what preoccupied the mind of the judge was the pending matter then the new notion Ihenachor’s lawyers led by Dee Nwingwe (SAN) and S. Amadi Obi raised asking for determination.
According to the judge, the motion is new adjourned to December 9, 2014 for determination after hearing the submission of the parties involved.
By Implication, Capt Ihenacho is in fresh trouble. The precarious situation arises from the fact that since APGA guber primaries would hold Monday, December 8, 2014, Ihenacho may not participate considering the fact that the unvacated motion ex-parte asking him not to participate in APGA screening is still in force.
